DMCA Policy

Users may only publish content they own or are authorized to use. If you believe material on TheLinkTree infringes your copyright, you may submit a DMCA takedown notice as described below. We will respond to valid notices in accordance with applicable law.

To report alleged copyright infringement, send a written notice to our designated DMCA agent at [email protected] with the subject line “DMCA Takedown Notice”. You may also use our Contact Us form and clearly state that your message is a DMCA notice.

Your notice must include substantially the following:

1. A physical or electronic signature of the copyright owner or authorized agent.
2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
3. Identification of the material that is claimed to be infringing, with information reasonably sufficient to locate it (for example, the profile URL and a description of the content).
4. Your contact information, including name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Incomplete notices may delay processing. Knowingly submitting a false DMCA notice may result in liability under 17 U.S.C. § 512(f).

If your content was removed due to a DMCA notice and you believe the removal was a mistake or misidentification, you may submit a counter notification to [email protected] including:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number.
5. A statement that you consent to the jurisdiction of the federal district court for your address (or any judicial district where TheLinkTree may be found if outside the U.S.), and that you will accept service of process from the original complainant.

Upon receiving a valid counter notification, we may restore the material unless the copyright complainant files a court action and notifies us as required by law.

In appropriate circumstances, TheLinkTree will disable and/or terminate accounts of users who are repeat infringers. We may also remove content and suspend accounts for clear or egregious infringement even after a single notice.
